Terms & Conditions

These are our terms and conditions of business. You should feel confident and comfortable when ordering from us, and we ask you to agree to these terms and conditions when placing an order. Please feel free to contact us with any questions by email.

 

 

 

Definitions

 

“Buyer” means the individual or organisation that buys or agrees to buy the Goods from the Seller. “Goods” means the articles that the Buyer buys from the seller through the Internet. “Seller” means Yoke Enterprises Ltd “the website” means https://www.yokeshopper.com.

 

Conditions

 

Nothing in these Terms and Conditions shall affect the Buyer’s statutory rights as a Consumer. These Terms and Conditions shall apply to all contracts for the sale of Goods by the Seller to the Buyer and shall prevail over any other documentation or communication from the Buyer. Acceptance of delivery of the Goods shall be deemed conclusive evidence of the Buyer’s acceptance of these Terms and Conditions. Any variation to these Terms and Conditions (including any special terms and conditions agreed between the parties) shall be inapplicable unless agreed in writing by the Seller.

 

Out of stock products

 

In most cases the product will be withdrawn from the website when out of stock. In the eventuality of a product being ordered online that is then found to be out of stock, the buyers will be given the opportunity to wait until the goods are in stock or cancel their order. The Seller reserves the right to make changes to pricing and shipping at any time without any due notice to consumers.

 

Prices and payment

 

All products prices shown on this website include VAT (at 20%). Product prices include the cost of delivery. Payment must be made in full before goods are packed and dispatched.

 

Deliveries

 

For full details of our delivery options and charges please see Delivery and Returns page. Orders for delivery within the UK and overseas will be dispatched by Royal Mail. All reasonable efforts will be made to deliver goods within 3 – 5 working days within the UK and 5 – 10 days for international orders. Yoke Enterprises Ltd does not accept any liability for any losses, costs, damages or expenses incurred by the buyer or any other third party, arising directly or indirectly from a delivery arriving outside of the expected delivery period. Please note that in certain circumstances, e.g. a postal strike, a delivery may be delayed. We make every effort to make sure that your goods are delivered on time, but we cannot take responsibility for circumstances outside of our control that result in goods being delayed in transit. Deliveries will be made to the Buyer’s address specified in the order and the Buyer shall make all reasonable efforts to take delivery of the order. Title and risk in the Goods shall pass to the Buyer upon receipt of the delivery.

 

Deliveries to non-EU postal addresses

 

Non-EU customers will be responsible for any duty or taxes that may be levied in their own country. The purchase price paid to Yoke Enterprises Ltd covers the goods you order and postage and packing only.

 

Currencies

 

If you are purchasing from abroad you will be charged in your own currency and the banks will perform a currency conversion automatically so that we receive Pounds Sterling. A currency converter is available at http://www.xe.com/ucc – as a general guideline only. The bank may debit a slightly different amount.

 

Cancellation and returns

 

We offer a money back guarantee if you are not satisfied with your purchase. Please send us an email using our online contact form briefly stating the reason for returning the item. You are able to return the Yoke Shopper undamaged within 30 days for an exchange or a refund of the item price, however please note we do not pay return postage on unsuitable items. This does not affect your statutory rights. If the goods are not faulty, the cost of the goods and outward delivery will be refunded, but not the return postage and any relevant insurance. The goods remain under the Buyer’s title until they are received by Yoke Enterprises Ltd. The Buyer must contact Yoke Enterprises Ltd by email with the reason for wanting to return the goods. We will then get in touch with you about returning the product. For all products other than the Yoke Shopper, as a consumer you have the right, in addition to your other rights, to cancel the Contract and receive a refund by informing the Seller in writing within 7 full working days starting from the day after which the goods are delivered, as long as the goods are in re-saleable condition and have not been taken out of their original packaging.

 

Rights of the seller

 

The Seller reserves the right to adjust the price and specification of any item on the website at its discretion. The Seller reserves the right to withdraw any goods from the website at any time. The Seller shall not be liable to anyone for withdrawing any Goods from the website or for refusing to process an order.

 

The transaction process

 

To enhance the security of the transactional information we process and to protect ourselves and our valued, legitimate customers in the event of any fraudulent orders, transactions processed through our Payment Service Provider — Paypal — are scored and checked using a complex set of fraud rules. This set of rules is maintained and updated by Paypal, and any transactions that meet certain criteria will be flagged for our attention. As the customer, if your payment details are found to be invalid after your order has been flagged by Paypal, we will email you to inform you that your order has been cancelled and that payment has been declined. We reserve the right to carry out this action even after you have successfully completed the purchasing process on our website and received a confirmation of sale message on the site and/or via email.

 

Limitation of liability

 

Except as may be implied by law where the Buyer is dealing as a Consumer, in the event of any breach of these Terms and Conditions by the Seller the remedies of the Buyer shall be limited to damages which shall in no circumstances exceed the price of the goods and the seller shall under no circumstances be liable for any indirect, incidental or consequential loss or damage whatever. Nothing in these Terms and Conditions shall exclude or limit the liability of the Seller for death or personal injury resulting from the negligence of the Seller or that of the Seller’s agents or employees.

 

Waiver

 

No waiver by the Seller (whether express or implied) in enforcing any of its rights under this contract shall prejudice its rights to do so in the future.

 

 

Force Majeure

 

The Seller shall not be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to acts of God, strikes, lock outs, accidents, war, fire, breakdown of plant or machinery or shortage or unavailability of raw materials from a natural source of supply, and the Seller shall be entitled to a reasonable extension of its obligations.

 

Severance

 

If any term or provision of these Terms and Conditions is held invalid, illegal or unenforceable for any reason by any court of competent jurisdiction such provision shall be severed and the remainder of the provisions hereof shall continue in full force and effect as if these Terms and Conditions had been agreed with the invalid illegal or unenforceable provision eliminated.

 

Changes to terms and conditions

 

The Seller shall be entitled to alter these Terms and Conditions at any time. However, this right shall not affect the existing Terms and Conditions accepted by the Buyer upon making a purchase.

 

Governing law and jurisdiction

 

These Terms and Conditions shall be governed by and construed in accordance with the law of England and Wales and the parties hereby submit to the exclusive jurisdiction of the English and Welsh courts.

 

Intellectual property and right to use

 

You acknowledge and agree that all copyright, trademarks and all other intellectual property rights in all material or content supplied as part of the website shall remain at all times vested in us. You acknowledge and agree that the material and content contained within the website is made available for your personal non-commercial use only. You agree not to (and agree not to assist or facilitate any third party to) copy, reproduce, transmit, publish, display, distribute, commercially exploit or create derivative works of such material and content.

 

Privacy Policy

 

Any data submitted via forms on this site will be held in accordance with the Data Protection Act. All credit card data is held by Paypal. No credit card data is held by Yoke Enterprises Ltd.
